The Trans Pacific Partnership (TPP) agreement currently under negotiation could represent a dynamic shift in the language, content and application of trade agreements for the 21st Century. Foremost among the new aspects being covered are the so-called ‘Horizontal Issues’—cross cutting issues such as regulatory coherence, SME (Small and Medium sized Enterprises) priorities, global supply chains, and similar topics that reflect the way businesses need to operate in the 21st century.
How will the baseline language go into the chapter(s) on Horizontal Issues? Will it be adapted from existing FTA’s, or entirely new? Will a final TPP template be applicable to future agreements? Or will it be too geographically specific—or too broad to be effective?
