OhioConstructionLawyer.com Ohio has some issues with its retainage laws. There is NO statutory control over retainage on private projects. There is SOME control on retainage for public projects with the new Public Bidding Laws, but there is still room for abuse. We have statutes because there is an imbalance of power and there has to be a certain base line of rules for EVERYONE to follow.
Ohio made it part way with the new Public Bidding Laws and part way the its Prompt Pay Laws, but there is just no substitute for a good contract.
