Today we'll discuss what you should do if you are arrested (or if someone you know has been arrested).
We are often asked: "What should I do after I've been arrested?" This is a very important question to ask, and understanding the importance of what you do next is vital for your future. Listen as experienced criminal defense attorney Terry O'Malley (who practices in Denver, Adams, Larimer, Jefferson, Arapahoe and Douglas County, Colorado) explain what you should do after your arrest.
The most important thing to do if you (or someone you love) is in police custody is to not make any statements to the police. This applies whether you are in person or on the phone. Whether you are the one who is arrested, or a loved one - don't say ANYTHING about the case in question or the incident which resulted in their arrest. You have no legal obligation to speak with the police. When they question you, simply say that you have a lawyer, or wish to hire a lawyer, and are not speaking about the case.
If a friend, family member, or loved one is in jail, don't speak about their arrest or case when you visit them or talk on the phone. Every phone call and visit an inmate receives is recorded. The CD is reviewed by the District Attorney in the case - the person who is prosecuting their case.
Above all, keep in mind that law enforcement officials, sheriff's deputies and police see it as their duty to convict people of crimes. They're not neutral - they're not trying to help you. They're trying to "catch the bad guys" and get a pat on the back.
If you or a loved one has been accused of a crime in Colorado, be smart, exercise your right to remain silent, and contact a criminal lawyer at the O'Malley Law Office at 303-830-0880. Together, we can protect your future.
The O'Malley Law Office practices throughout Colorado in Counties such as:
Denver | Adams | Arapahoe | Douglas | Jefferson | Broomfield | Larimer | Weld | Morgan | Logan
