South Carolina: As if the Grief Were Not Enough

Another Case of Criminalizing Pregnancy Loss: In June, 2025, a South Carolina woman miscarried at 18 weeks. She sought medical care. But hospital staff called Child Protective Services and police arrested her for a felony. The charge? “Desecration of Human Remains.” In the USA, if you can get pregnant, your life and liberty are at risk.

This is a trend. Police and prosecutors in several states have been cruelly arresting miscarriage patients and charging them with improperly disposing of fetal remains even though there are no legally established guidelines for that.
