The ADM is now for over 20 years a community of people who are closely linked to each other by the space, visions and creations they share. The cultural free haven ADM is one of the last large live/work communities of Amsterdam. On the terrain reside now some 125 people from all ages, nationalities and walks of life.
Among them are: children and pensioners, theater-makers and stage-builders, inventors and technicians, dancers and musicians, actors and directors, crafts-men and women, sailors and buccaneers, life-lovers and different-thinkers...
The current situation is that we have 2 eviction verdicts on our plate right now:
1. through administrative law:
In a court-case which Chidda BV started against the municipality, the judge ruled that the city can no longer abstain from enforcing the local zoning-plan. Since the area we live in is officially designated for industrial use only, 'enforcing the zoning-plan' in this case would mean a complete eviction of ADM.
Both the city of Amsterdam and the ADM-community are appealing this verdict.
It could take a full year before the appeal-case is concluded. We may have to apply for an interim measure to prevent eviction from taking place before the case is even reviewed.
However the municipality did also start an eviction procedure. On August 5th. 2017 they sent us a letter saying that we have only 6 months to 'stop living' at the ADM and if we not comply that they'll evict us on February 5th. 2018.
So we also appealed against this decision of the municipality. This will be dealt with on shorter notice, possibly before their planned eviction date. If not the municipality and/or we have to go to court in order to get an interim measure.
2. through civil law:
We have to be evicted 6 months after the planning permit for Chidda's (fake) plans is issued by the ODNZKG (=> regional governmental body).
This is a permit consisting of many small parts. Where we can and find a legal base, we appeal against these parts (mainly for flora and fauna related issues)
We also strongly believe that the (fake) plans of Chidda BV and their renter (Koole Maritme BV) don't comply with the perpetual clause which was part of the buying contract, when Chidda bought the ADM terrain in 1997. We're busy, together with the left wing parties in the city council, to organize a hearing with independent experts, to investigate this issue.
What this verdict means should the permit become unusable is unclear.
