H. Gavin Long BISNAR CHASE – Personal Injury: Butenhoff v. Bautista. Gavin obtained a $3M gross verdict after a 7 day jury trial in an auto v. pedestrian case. Plaintiff, a good Samaritan, was standing in the #1 lane assisting a woman whose dog had been hit by a car. It was nighttime and in a residential neighborhood. Defendant was driving in the #1 lane, swerved to avoid the dog, and hit Plaintiff. Plaintiff suffered a MTBI, fractured hip (no surgery) and a torn meniscus (no surgery). Allstate denied liability because the policy report attributed 100% fault to plaintiff. Allstate also disputed the extent of Plaintiff’s injuries because he had recovered within seven months, and was back to the same physically demanding type of work --- building and maintaining cell sit towers. This was a no offer case until two months before trial when Allstate offered the $100k policy, which was rejected. Gavin waived specials and loss of earnings.
