The Skills-Based training series is designed for attorneys, supervisors, legal staff, and aging services providers. Each training will provide practical tools needed to effectively represent older clients.
This legal skills webcast covers legal capacity & ethics. Attorneys sometimes face the challenging task of making an initial capacity assessment of their client or potential client. While most older adults will not have impaired capacity, some will. Clients with early stages of dementia or mild cognitive impairment may have subtle decisional challenges.
This training provides a framework and practice tips for addressing questions of client capacity, and addresses ethical considerations.
Participants will learn when and how to conduct an initial capacity assessment and how to ethically represent an individual with diminished capacity.
Webcast participants will also receive practice tips and a capacity worksheet for lawyers. The materials will be available at ncler.acl.gov.
