While legally you have the ability and there is a small chance for a reduction in your case, it is not likely. DUIs (or Driving while Under the Influence) are cases that bring up strong moral convictions within a community. Most people of the community want a much stronger punishment on these types of crimes so as not to encourage anyone else to commit these acts. The police and prosecution are elected officials and having a high rate of convictions on DUI cases is a good one to get reelected.
However, it is still possible to get the charges reduced. If we’re able to prove that it’s more likely that you were never supposed to be arrested for a DUI, your chances of getting the charges reduced increase greatly. Did you pass the field sobriety test but still smell like alcohol? Or did you take a breath test and fail but pass the sobriety test with no problems?
