This is a meeting of the Rent Leveling Board of the City of Hoboken, New Jersey. The meeting took place on the evening of Wednesday, February 22, 2012, at six-thirty p.m., in the basement conference room of the Hoboken City Hall building. Two cases were heard at this meeting: The first case deals with the question of a condo owner-occupancy going to the rental market. The question at issue was: Is the unit exempt from rent control for its first rent (referencing rent-control regulation, not the rent-control ordinance). Also whether the question of "equitable authority" (as per the Z-88 amendment to the rent-control ordinance) applies.
The second case was to determine whether owner-occupancy was applicable on two units in a three-unit building. Was the base rent set on a recent tenant of one of the units, and does another unit not yet have a base rent because it has always been -- and is still -- owner occupied. The question brought to the board on these two units was about demonstrating owner-occupancy.
