Today Im back with another hot tip for renters and it has to do with smoking in your building.
Let's say your friend comes by and brings you a real nice cigar but its the middle of winter, and you'd like to smoke it indoors.
Can your landlord evict you for that?
The answer is "nO". A landlord can not evict you for smoking in your building, even if you have a "No smoking" clause in your lease.
The only exceptions to the rule are if you live on a non-smoking building, or if your smoking is bothering a neighbor. In that case those are both grounds for eviction.
So, Can your landlord evict you for smoking in your building? No he can't.
But is it cool to smoke in your building? No its not.
If you're a tenant and you've signed a lease that says "no smoking", Don't be a dick! Don't smoke in the unit!
