Should our nation's legal system be hostile to "patent trolls?" In other words, should our patent law discriminate against patentees who, in the words of President Obama, "don’t actually produce anything themselves"? Professor Duffy's talk considers both the new and the old approaches to non-practicing entities and shows how they reflect fundamentally different theories about the goals of the patent system and the types of disclosure that the system is intended to foster.
