    The 2012 settlement with the nation's top lenders included their signing of a 100-plus page complex consent judgement. Eric Lanigan reviewed the document and explains the valid use of the judgement in regards to stopping a bank from dual tracking of a homeowner.

    Eric explains that if there is a witness brought by the bank, the attorney trying the case must be able to properly find weaknesses in the witnesses' story on cross examination. Establishing that the witness couldn't possibly know when the note was lost or who lost the note, then they're not going to be able to establish the lost note. And if they can't establish the lost note, then they can't establish their case

    In any case where you are defending your home against a bank you should be working with an attorney who has extensive foreclosure litigation experience and who is very knowledgeable about the rules of evidence.
