1. There are no debtor's prisons in the United States. If a bill collector or creditor tells you otherwise, they are lying and most likely violating federal law.

    If you owe money to a credit card company, your creditor's only recourse is to file a collection lawsuit. If you are sued, you should contact a lawyer immediately to discuss possible defenses and/or using bankruptcy protection to avoid wage garnishment and bank account seizure.

  4. Just about every Chapter 13 debtor will receive an objection to confirmation. This does not mean your case is over, it just means that there is more work to do.

    After your case is confirmed, you may get a trustee Motion to Dismiss. Again, this does not mean that your case is over.

    If, however, you receive a letter from the trustee or creditor stating that your case is being challenged, drop what you are doing and call your lawyer immediately. Time frames in bankruptcy are short and delay can cost you time and money.
