Breach of loyalty is often one of the biggest pitfalls for an employee, especially if they are contemplating leaving their current employer, whether for employment with another company or to create their own business. Do not attempt to contact competitors, vendors, etc., while you are still working and receiving compensation from current employment.

Employees should consider the impact that social media can have on your employment. Once you have posted something on Facebook or Twitter, you have created a trail of evidence that can be discovered and used against you. One should always be mindful of the fact that you always leave a trail when on the internet, and posted information is public, even if you think your profile is "private". Every case is different, but the facts always matter. So, what can be said generally doesn't offer much guidance. However, you should know that there are two general category of issues: Liability and damages. First, looks at whether there was a legal wrong committed. Second, looks to whether the wrong was the cause of injury. Of course, you cannot tell the whole story in a minute forty. You should probably know that negligence and contract are the primary source of duties, but there can be others. The other important source of legal obligations to others can be found in statutes. And, the violation of statutes can give rise to claims for damages. But, there are other torts than negligence that may arise in the context of your dealing with others. To be sure, consulting a lawyer in the appropriate jurisdiction is necessary. Also, as stated in the video, you must suffer damages. Almost getting hit by a car means you were almost damaged. But, as the saying goes, this ain't horseshoes, and almost isn't good enough.
